• —Exsurgo Performance System (EPS)
• —Performance assessment tools
• —Mobile and web-based software
• —Data collection and reporting services
• —Integrations with third-party platforms
• —Future products and updates

We reserve the right to modify, discontinue, or update products and services at any time without prior notice.

Account Responsibilities

Certain features may require an account or organizational membership. You agree to:

• —Maintain the security of your login credentials
• —Notify us of unauthorized account activity
• —Accept responsibility for activity occurring under your account

Organizations, coaches, schools, teams, and facilities may manage user access within their organization.

• —Services will operate uninterrupted
• —Products will meet every specific performance expectation

Environmental conditions, user setup, calibration, third-party integrations, hardware limitations, and user error may affect performance and accuracy.

Pricing and Payment Terms

All prices are listed in U.S. Dollars unless otherwise stated. We reserve the right to:

• —Refuse or cancel orders
• —Limit quantities
• —Correct pricing or product description errors

Payment must be completed before products are shipped unless otherwise agreed in writing.

Shipping Timelines and Risk of Loss

Shipping timelines are estimates and are not guaranteed. Exsurgo is not responsible for delays caused by:

• —Customs processing
• —Weather
• —Supply chain disruptions
• —Incorrect shipping information provided by customers

Risk of loss transfers to the purchaser upon delivery to the shipping carrier unless otherwise required by law.

Warranty Coverage and Returns

Warranty coverage, return eligibility, and replacement policies may vary by product. Unless otherwise stated in writing:
